To Shout Into the Resounding Silence

Justice Dept. Probing Domestic Spying Leak

WASHINGTON - The Justice Department has opened another investigation into leaks of classified information, this time to determine who divulged the existence of President Bush's secret domestic spying program. The inquiry focuses on disclosures to The New York Times about warrantless surveillance conducted by the National Security Agency since the Sept. 11 terrorist attacks, officials said. The newspaper recently revealed the existence of the program in a front-page story that also acknowledged that the news had been withheld from publication for a year, partly at the request of the administration and partly because the newspaper wanted more time to confirm various aspects of the program.

So that "crime" gets an immediate response and the President's does not?

No.

If we can show that the President is operating outside the law in these matters without being challenged, then the rule of law here in America is dead. Therefore action against this administration falls under the pledge to protect America against "all enemies, foreign and domestic".

The coming weeks will tell the tale of our republic. As others have already pointed out in various places on the web, the President has thrown down the gauntlet. "Yes I broke the law, and I'll do it again because I can" sums up Bush's attitude about these revelations.

If our elected "leaders" in the House and Senate will not act when such brazen disregard for the rule of law cccurs in America's highest office, we the people will be forced to.

I want to know what the exact legal arguments are and exactly what laws the President may have broken. It's not enough just to say "Bush broke the law". I want to be able to say which laws he broke.

I need all relevant information regarding the Fourth Amendment and any an all legal arguments that have thus far been published on the Internet.

This is where we can start. All you link-happy web heads, now is your time. Find this information and formulate legal arguments. Post them here in the comments or e-mail at greenseptember05@yahoo.com.

I also need information about legal resistance to tyranny in regards to international law and the exact legal definitions of treason and sedition.

Tomorrow I have to work but I'll post some stuffs here once I get the necessary time. I've done some research and I've been terribly disappointed to find different point of views from lawyers working all over the States when they have to interpret the 4th amendment, and we all know "by beleifs" that they do spy on US citizens (Cf the story of the cookies and the NSA on google)

I'd say, it's not what a person owns, but it is what a person seeks to preserve privately far from the public eyes that goes for the 4th amendment. Let's do some research anyway, we'll learn something at least. Be careful though because the MSM did not mention for some reasons other things: remember also there is that patriot Act and other laws that have been voted since 911. Here is an example: searching an "Al Qaeda" member in the US, even if he is a US citizen is legal under the Patriot Act. Right? But what do they call "Al Qaeda?" since it does not even exist as a rationnal organization (a leader with an army, or if not army then what is the law and why?), also why can't we investigate anymore the procedures of the FBI on a legal point of view? ... We may be in this stuff for months until we find that "The President is above the laws" because he said so and everybody's is in "AL Qaeda" organization because we don't even share their point of views.

Remember that Bill O'Leilly that stated that Sunnis from Iraq were terrorists.
Remember the anthrax threats from the far right american groups that were slowed down by the FBI and were used by the medias to convince Americans to go to war in Iraq.
Remember about V. Plame and her husband.
Remember about the NSA spying although considered as illegal was censored by the medias.
AND remember that the medias do not even have anymore freedom of speech.

    Fuck that BUllSHit.

You are angry, I'm beyond madness.

Here is some good shit, if you like grunge/alternative music. I know this band, they are only 3/4 people and they make lots of noise. Right now there is Mike (guitar, singing), Britney (bass) and Nic (drummer). Nic and Mike are my coworkers and I'm their manager and song writter (songs of revolt).

    We put some songs here:

I WANT YOU TO CHECK IT OUT and tell me what you think about it. The name of the band is called "scribblehead" but we may change it. They are not famous because they'll never get their shit together LOL. The music looks like STP, Nirvana, ... etc If you like it, then let me know, I'll put it on bittorent. You know they are like these bands that play slowly and go all nuts suddenly.

We put only 4 songs right now: Raking Leaves - Two Turtles - Postcard - Mascara (a story of people that put mascara and think they are vampires LOL).

Let me know what you think about it.

Any bets on whether the leaker in the Plame case will be found and punished before the leaker in this case?

I would like more information about that. For example there is most likely a fax or memo that was sent at the NYT. It is against the 1st amendment to withold information from Public (freedom of press).

    Look at this one:

"We are opening an investigation into the unauthorized disclosure of classified materials related to the NSA," said DOJ spokesperson Trent Duffy during a press conference earlier today.

"Any bets on whether the leaker in the Plame case will be found and punished before the leaker in this case?" ==== Dave: Sarcasm noted. There'd have to be pretty astronomical odds offered for *anyone* to make book on the proposition that the Plame leakers would be punished first. How curious that we *haven't* heard immediate, defeatist claims from the "Fuehrer" regarding how we'll likely "never know" the identity of the leaker in this new incident. (And my, the sparks are fairly *flying* off those jackbooted heels that previously dragged so relentlessly in the investigation of the Plamegate outrage.) This lying, hypocrital dictator and his ruthless thugs MUST go, by any means necessary!
